SELECT COMFORT PRIVACY POLICY
The following privacy policy describes the information and privacy practices for Select Comfort in relation to any Select Comfort® retail stores located in Canada, to www.selectcomfort.ca and all other locations, occasions or events where your personal information is collected by or on behalf of Select Comfort in Canada. Our policies and practices have been put in place to comply with the federal Personal Information Protection and Electronic Documents Act (PIPEDA) and any applicable provincial privacy legislation.

With respect to our website, www.selectcomfort.ca, this privacy policy should be read together with our Copyright and Legal page.

From time to time, we may make changes to this privacy policy, which is current as of the "Effective Date" that appears at the top of this page. We will handle your personal information in a manner consistent with the version of this policy that is in effect at the time of collection, unless we have your consent to treat it differently.

When is information collected?
We will always collect your personal information using fair and lawful means. We will only collect your personal information directly from you, unless we have your consent, or are required or permitted by law, to collect it from a third party.

We identify our purposes for collecting your personal information, unless those purposes should be reasonably obvious to you (e.g. we collect your credit card number when you make a purchase on credit) or we are required by law to collect the information. Once our purposes have been identified, we limit our collection of personal information to what is reasonably necessary to fulfill those purposes. In other words, we do not, as a condition of supplying goods or services to you or on your behalf, or as an administrative or management requirement, require you to provide us with personal information beyond that required by us to supply those goods or services.

When you visit our Canadian website,
www.selectcomfort.ca, we use a feature of your Internet Web browser called a "cookie" to assign a unique identification to your computer. Cookies are small data files that a Web site or e-mail may send to your browser, which may be stored on your hard drive.

Select Comfort does not use cookies to retrieve personal information from your computer unless you knowingly and willingly provide such information. Select Comfort will not use cookies to store personal information, such as credit card numbers, nor can any other Web site read the information we store in the cookie.

On the Internet, our vendors gather data and information concerning movement through our web sites for the purpose of enhancing your experience on our site. Cookies may be used for this purpose.

You may choose to set your Web browser to not accept cookies. If your cookies are disabled, you can still view our site, but you will not be able to create an account or make purchases.

We also use pixel tags, which are tiny graphic images, to tell us what parts of our Web site you have visited or to measure the effectiveness of any searches you may do on our site. Pixel tags also let us know when you have opened an e-mail message from us. You may choose to disable pixel tags by setting your browser to be in text mode only.

How does Select Comfort use the information it collects?
Any information about our customers is used solely for the identified purposes in order to better serve our customers, or as required by law. If we intend to use your personal information for a purpose not previously identified to you, we will inform you of the new purpose and seek your consent to use your personal information for that purpose, unless we are required by law not to do so.

As a condition of doing business with Select Comfort, all of our vendors and business partners are required to follow Select Comfort's privacy policy and to take reasonable measures to ensure your personal information is secure.

From time to time, we may be required to share personal information in response to a valid court order, subpoena, government investigation or as otherwise required by law. We also reserve the right to report to law enforcement agencies any activities that we, in good faith, believe to be unlawful. We may share certain personal information when we believe that such release is reasonably necessary to protect the rights, property and safety of others and ourselves.

We may also transfer personal information in the event of an actual or prospective corporate sale, merger, acquisition, dissolution or similar event.

Types of Consent
We will obtain your consent, where required, prior to collecting, and in any case prior to using or disclosing your personal information for any purpose. Depending on the circumstances, your consent may be express or implied.

Express Consent requires a positive act by you, and can be given, for example, in writing, in person, electronically, by telephone, or by using a check-off box to opt-in. We will always seek your express consent in order to use or disclose your sensitive personal information, such as financial or medical information.

Implied Consent does not require a positive act by you and may be relied on by us as a basis for collecting, using or disclosing your non-sensitive personal information, unless you specifically indicate to us that you are not providing your consent. For example, your use of the services provided on our website, www.selectcomfort.ca, is relied on by us as your implied consent to the information practices set out in this privacy policy.

What are my choices regarding the use and disclosure of my information?
You may choose not to provide us with any of your Personal Information. However, if you make this choice we may not be able to provide you with the product, service or information that you requested or that could be offered to you. For example, we can only offer you a credit card if you have provided us with certain Personal Information of a financial nature.

You may also withdraw your consent at any time, subject to legal or contractual restrictions and reasonable notice. If you withdraw your consent, we will inform you of the implications of such withdrawal. To withdraw your consent, simply contact us and advise us of what Personal Information you no longer wish us to use.

To withdraw your consent to our use or disclosure of some or all of your personal information, contact Select Comfort using one of the following options:

  1. Follow the instructions on a marketing e-mail from us. All marketing e-mails from Select Comfort will tell you how to stop receiving them.
  2. Contact our privacy officer by email or regular mail using the contact information provided at the end of this privacy policy.

Be sure to include your current contact information, including your full name, address, phone number and e-mail address. Indicate specifically what type of personal information you want us to stop using or disclosing. This will ensure we identify you correctly in our systems and accurately process your request. Please be assured that we will not use the contact information you provide with your withdrawal for any other purpose.

Select Comfort will take the appropriate steps to implement your withdrawal request within a reasonable period of time, however please note that we may not be able to process your request in time to prevent a regularly scheduled communication from being sent to you in the interim.

Also, please note that if you opt out of receiving marketing communications, you may still receive business-related communications such as order confirmations, product recall information, loyalty program membership status/updates or other organization-related communications unless you also withdraw your consent to receiving those types of communications.

How long will Select Comfort keep my information?
We will keep your personal information on file only for as long as is necessary to fulfill the identified purposes for which we collected it, or as otherwise required or permitted by law. Once we no longer require your personal information for the identified or for legal purposes, it will be destroyed, erased or made anonymous as appropriate to the sensitivity of the information.

How can I check the accuracy of and/or access my information
We will use reasonable efforts to ensure that your personal information is kept as accurate, complete, and up-to-date as necessary for the identified purposes for which we collected it, or as otherwise required by law. We will not routinely update your personal information, unless such a process is necessary in light of the identified purposes.

In order to help us maintain and ensure that your personal information is accurate and up to date, you must inform us, without delay, of any change in the information you provided to us.

You can at any time challenge the accuracy or completeness of, or request access to, the personal information we have about you, subject to the exceptions provided by applicable law. You may also ask for a description of how your personal information has been used and to whom it has been disclosed. We may ask you to put your request in writing, in which case it should be delivered to the email or postal address provided at the end of this privacy policy. Please be as specific as possible in your request so that we can meet the applicable time lines. In addition, for security purposes, please not that we will need specific information from you to verify your identity.

If you have made a request for correction, we will amend the personal information within a reasonable time where appropriate, or we will annotate your file to indicate that the request was made. We will also transmit the corrected information, as appropriate, to any third parties who have access to your information in order to perform services on our behalf.

If you have made a request for access, we will provide such access, subject to applicable laws, at minimal or no cost to you.

How secure is my personal information?
Please be assured that we have reasonably appropriate physical, electronic and procedural security safeguards in place and we take reasonable precautions to protect against the loss, misuse and unauthorized access of your personal information under our control. The nature of the safeguards varies depending on the sensitivity of the personal information that has been collected; the amount, distribution, and format of the personal information; and the method of storage. More sensitive personal information is safeguarded by a higher level of protection. We will continue to review our practices to ensure that they remain in strict compliance with applicable law.
